The short version.

These terms govern your use of Wiley, a website analytics and AI coaching service provided by FunnelMelt LLC. Use Wiley honestly, don't abuse it or resell access, and you're responsible for your own site's compliance and for evaluating whether to act on Wiley's AI-generated suggestions — they're coaching, not guarantees or professional advice. Paid plans bill monthly and you can cancel anytime; you own your content, we won't sell your data, and you can delete your account whenever you want. The full terms below cover the specifics, including the standard liability and warranty language every SaaS agreement needs.

These terms govern your use of Wiley, a website analytics and AI coaching service provided by FunnelMelt LLC ("FunnelMelt," "Wiley," "we," "us"). By creating an account or using Wiley, you agree to these terms. If you don't agree, don't use the service.

1. What Wiley is.

Wiley provides a lightweight analytics tracking script for your website and uses the data it collects — along with, if you choose to connect it, evidence from third-party sources like Google Analytics — to generate periodic coaching emails ("Nudges") and on-demand suggestions ("Boosts") intended to help you understand and improve your site. Wiley also offers optional related features, including accessibility scanning, search rank tracking, page-speed monitoring, and a page/blog publishing tool ("Just Me").

Wiley's Nudges and Boosts are generated with the help of AI (Anthropic's Claude). They're coaching suggestions based on the evidence available to Wiley at the time — not professional, legal, financial, medical, or accessibility-compliance advice, and not a guarantee of any particular outcome (more traffic, higher rankings, more conversions, or otherwise). You're responsible for evaluating and deciding whether to act on any suggestion Wiley makes.

2. Your account.

You must provide accurate information when creating an account and keep it up to date. You're responsible for activity that happens under your account, including keeping your login credentials secure. You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create a Wiley account.

You're responsible for having the right to install Wiley's tracking script on any site you connect, and for your site's own compliance with laws that apply to it (including, where applicable, disclosing your use of analytics tools to your visitors).

3. Plans and billing.

Wiley offers a Free plan and paid plans (currently Solo, Plus, and Pro), each with different features and site limits, billed monthly through Stripe. Paid plans renew automatically each billing period until canceled. You can cancel at any time from your account settings — cancellation takes effect at the end of your current billing period, and we don't provide partial refunds for unused time in a period. Boost packs, where offered, are one-time purchases that don't expire and aren't refundable once purchased, except as required by law.

We may change plan pricing or features going forward. If we do, we'll make reasonable efforts to notify active subscribers before a price change takes effect on their next billing cycle.

4. Your content and data.

You retain ownership of your site content, the data your site generates, and any content you create using Wiley's features (including Just Me pages and posts). By using Wiley, you grant us the license needed to process that data and content to operate and improve the service — for example, to generate your Nudges, run the accessibility scanner, or display your Just Me pages. We don't sell your data, and we don't use your site content to train AI models.

5. Third-party connections.

Wiley integrates with optional third-party services you may choose to connect, including Google Analytics, Bluesky, and others as they become available. When you connect one of these, your use of that connection is also subject to that provider's own terms — for example, connecting Google Analytics means your use of Google's services is also governed by the Google Terms of Service.

Where Wiley accesses your data through a Google API (such as the Google Analytics Data API), that access and Wiley's use of the data it returns complies with the Google API Services User Data Policy, including its Limited Use requirements — see our Privacy Policy for what's actually imported and how it's used. You can revoke Wiley's access to any connected third-party account at any time from your account settings, or directly from that provider's own account security settings.

6. Acceptable use.

You agree not to:

  • Use Wiley to track, publish, or process content that's illegal, infringing, or that you don't have the right to use
  • Attempt to access another user's account or data without authorization
  • Interfere with or disrupt Wiley's infrastructure, or attempt to bypass rate limits, plan limits, or other access controls
  • Reverse-engineer, decompile, or attempt to extract the underlying logic of Wiley's tracking script, coaching prompts, or scanning tools, beyond what's needed for ordinary use of the service
  • Use Wiley's outputs (Nudges, Boosts, generated content) to build a directly competing product
  • Resell or sublicense access to Wiley without our written permission

We may suspend or terminate accounts that violate this section.

7. Service availability.

We aim to keep Wiley reliably available but don't guarantee uninterrupted access. Wiley is built on Cloudflare's infrastructure and depends on third-party services (including Anthropic's Claude, Stripe, and any analytics providers you connect) that are outside our control — an outage or change on their end can affect Wiley's availability or accuracy. We may perform maintenance, and we may modify or discontinue features with reasonable notice where practical.

8. Disclaimers.

Wiley is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that Wiley's analytics, AI-generated coaching, accessibility findings, rank tracking, or any other output is complete, accurate, or error-free — these are automated and AI-assisted tools, not a substitute for professional judgment, a legal accessibility audit, or a compliance certification.

Different analytics sources (including Wiley's own tracking and any third-party source you connect, like Google Analytics) commonly report different numbers for the same period due to differences in how each one measures traffic. That's expected and isn't a defect in the service.

9. Limitation of liability.

To the fullest extent permitted by law, FunnelMelt LLC won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of revenue, data, or business opportunity, arising from your use of Wiley — even if we've been advised of the possibility. Our total liability for any claim relating to Wiley is limited to the amount you paid us for the service in the 12 months before the claim arose, or $100 if you're on the Free plan.

Some jurisdictions don't allow certain limitations on liability, so some of the above may not apply to you.

10. Termination.

You may stop using Wiley and delete your account at any time from account settings. We may suspend or terminate your access if you violate these terms, if required by law, or if we discontinue the service — where practical, we'll give notice first. On termination, your right to use Wiley ends, though provisions of these terms that by their nature should survive (including Sections 8, 9, and 11) will continue to apply.

11. Changes to these terms.

We may update these terms from time to time. If we make a material change, we'll update the "Last updated" date above and, where practical, notify active account holders. Continuing to use Wiley after a change takes effect means you accept the updated terms.

12. Governing law.

These terms are governed by the laws of the State of South Dakota, without regard to its conflict-of-law principles, and any dispute arising from these terms or your use of Wiley will be resolved in the state or federal courts located in Pennington County, South Dakota, except where applicable law requires otherwise.
